East Metro Business Park

The following notes are upon the Final Plat of the East Metro Business Park recorded in Volume 57-098B of Plats on Page 381, as Document Number 2981803,:

NOTES:

  1. Erosion control and detention requirements to be approved on a lot by lot basis at time of application for building permit. Detention requirements shall meet City of Madison General Ordinance Chapter 37.
  2. All erosion control measures and all stormwater detention and retention structures are to be approved by the Town of Burke and the State of Wisconsin D.O.T., on a lot by lot basis, prior to the construction of any improvements. Once construction has begun all measures and structures so approved must be implemented in a timely manner to prevent any storm water erosion or escape from the lot. Following the completion of the improvements no changes to the structures or measures may be made without the further approval of the Town of Burke and the Wisconsin D.O.T. Any owner or any person acting on behalf of such owner(s) who shall violate any such drainage restrictions or limitations shall reimburse the party seeking enforcement of the covenants, providing they prevail in a court of equity or judgement, for all costs and expenses incurred, including but not limited to reasonable attorneys fees and costs, provided such party is the prevailing party in any such action for enforcement. The erosion control, detention and storm water restrictions set forth herein are for the benefit of the Town of Burke, the State of Wisconsin D.O.T., and every owner(s) of a lot(s) within the East Metro Business Park Plat; and all such restrictions, limitations, and covenants may be enforced by the foregoing persons, or any one of them, in the event of a breach by any other person(s).
  3. All restrictions set forth in these notes constitute covenants that run with the lands described in the East Metro Business Park Plat.
